Terms & Conditions
AGREEMENT
Upon receipt of your payment, your curated travel planning process will begin and a contract will be made between you and TRAVELWELL ADVENTURES. By booking curated travel services or curated travel packages with us you agree to these Booking Conditions (which constitutes the entire agreement between you and us) and your booking will be accepted on this basis. The services to be provided are those referred to in your booking confirmation.
VALIDITY
The information and pricing provided on the website are valid for current services only.
SERVICE INCLUSIONS
TRAVELWELL ADVENTURES provides custom travel planning services as outlined on the website
SERVICE EXCLUSIONS
We do not include the following bookings:
Flight bookings (we will offer route advice)
Travel insurance bookings
Environmentally or ethically questionable activities
Drug/hallucinogenic experiences
DELIVERABLES
Once a trip is finalized, you will receive the following:
· Daily detailed itinerary in pdf format and/or via digital app
· All confirmations with contact information for vendors
· All vouchers/tickets for pre-booked activities
CURATED TRAVEL PAYMENTS
We require full payment for curated travel services prior to beginning the planning process. Payments can be made with major credit cards, PayPal, or Venmo.
For payments to travel vendors (ie accommodation, activities, transport etc), we require written approval of itinerary prior to booking with vendors. TravelWell Adventures will charge your card for the full amount of the approved items. This may be done in multiple increments depending on the complexity of the planning process.
CURATED TRAVEL BOOKING CONFIRMATION AND FINAL PAYMENTS
Once your payment is received, we will issue a confirmation email with an invoice. A contract will exist between you and TRAVELWELL ADVENTURES from the date we issue the confirmation invoice.
CURATED TRAVEL - CANCELLATION BY THE TRAVELER
You have 24 hours to cancel your travel planning services after payment is received in order to receive a full refund. After 24 hours and up to 72 hours service fees are refundable at 50%. After 72 hours, service fees are non-refundable. In order to confirm a cancellation, we need written confirmation. If you cancel a trip, you will be responsible for any non-refundable bookings already made.
TRAVEL PACKAGE PAYMENTS (PRE-PLANNED TRIP PACKAGES)
We require a $350 non-refundable deposit upon booking. Once the availability of the package is confirmed, the remainder of the trip cost will be due within 3 business days. In the case in which the package is not available for your dates, your deposit will be refunded. Payments can be made with major credit cards, PayPal, or Venmo.
TRAVEL PACKAGE BOOKING CONFIRMATION AND FINAL PAYMENTS
Once your deposit is received, we will issue a confirmation email with an invoice for the remainder of the amount due. A contract will exist between you and TRAVELWELL ADVENTURES from the date we issue the confirmation invoice.
TRAVEL PACKAGES - CANCELLATION BY THE TRAVELER
The $350 deposit is a non-refundable fee. In order to confirm a cancellation, we need written confirmation. The cancellation schedule is noted below. The refundable fees are based on the remainder of the trip cost after a non-refundable deposit:
More than 90 days prior to departure - Full refund
60- 90 days prior to departure - 75% of trip cost refundable
59 - 31 days prior to departure - 50% of trip cost refundable
0-30 days prior to departure - no refund
PASSPORT AND VISAS
You must carry a valid passport and have obtained all of the appropriate visas, permits and certificates for the countries in which you will visit during your trip. Your passport must typically be valid for 6 months beyond the duration of the trip. It is your responsibility to ensure that you are in possession of the correct visas, permits and certificates for your trip. While we will advise you of entry requirements, we are not responsible if you are refused entry to a country due to lack of a valid passport, visa or other travel documentation.
TRAVEL INSURANCE
We strongly recommend the purchase of travel insurance to protect your trip. Travel insurance is not included in your trip fees and must be purchased separately. While we can offer suggestions regarding reputable insurers, TravelWell Adventures is not liable for any claims or issues related to insurance coverage. By purchasing travel insurance, you can safeguard your investment against unexpected circumstances such as trip cancellations, medical emergencies, or lost luggage. We encourage all travelers to carefully review insurance policies, terms, and conditions before making a decision.
TRIP MODIFICATIONS
The nature of this type of travel requires the need for flexibility for the best and most effective experience. We are not responsible for any cancelled activities or bookings due to weather, local events, political situations, or other unforeseen circumstances. Every effort will be made to assist you in altering the itinerary as needed.
INDEMNIFICATION
You agree to indemnify, defend and hold harmless TRAVELWELL ADVENTURES, its affiliates, officers, directors, employees, agents, services providers and licensors from and against all losses, liabilities, costs (including without limitation attorneys’ fees and costs on appeal or at trial), damages, judgments, claims, of every kind and nature, to the fullest extent permitted by law, arising from or relating in any way to (i) your use of the Site, (ii) the products and services purchased through the Site, (iii) any liabilities, claims, damages and injuries arising from or related to any act or omission of a Service Provider or another third party, (iv) your conduct in connection with the Site, or (v) your violation of these Experiences Terms, the Terms of Service, any law or the rights of any third party.
EXCLUSION OF LIABILITY
TRAVELWELL ADVENTURES ("Travel Agent") acts only as an agent for the various independent suppliers that provide accommodations, transportation, sightseeing, activities, or other services connected with travel. Such services are subject to the terms and conditions of those suppliers. Travel Agents and their respective employees, agents, representatives, and assigns accept no liability whatsoever for any injury, damage, loss, accident, delay, or any other incident which may be caused by the negligence, defect, default of any company or person in performing the services. We do not accept liability for any loss, damage or expense resulting from war or terrorist activities threatened or actual, riot or civil unrest, industrial action threatened or actual, weather conditions, fire, flood, drought, closures, unforeseen alterations to public transport schedules, rescheduling of aircraft or boats, epidemic or outbreaks of illness or any other event outside our control which either delays or extends or reduces the trip, or compels a change in the trip arrangements after departure. All services and accommodations are subject to the laws and regulations of the country in which they are provided. Travel Agent is not responsible for any baggage or personal effects of any individual participating in the trips arranged by Travel Agent. Individual travelers are responsible for purchasing a travel insurance policy, if desired, that will cover some of the expenses associated with the loss of luggage or personal effects.
SEVERABILITY
In the event that any term or condition contained in these Booking Conditions is unenforceable or void by operation of law or as being against public policy or for any other reason, then such term or condition shall be deemed to be severed from this contract or amended accordingly only to such extent necessary to allow all remaining terms and conditions to survive and continue as binding.
GOVERNING LAW
The laws of California with the courts of California, govern this agreement and have exclusive jurisdiction over any dispute.
